Information we collect.
This website is built as static HTML and served from Vercel's content
delivery network. It contains no contact forms, no live chat widgets,
no third-party advertising or tracking pixels, and no behavioral
analytics from Google, Meta, or any other consumer-tracking platform.
The only interactive elements are mailto: and tel:
links that open your own email client or phone application.
Two categories of information are collected in connection with your visit:
Server logs
When your browser requests a page from the website, Vercel's infrastructure automatically records standard server-side information about that request. This typically includes your Internet Protocol (IP) address, the page or resource requested, the time of the request, the browser type and operating system reported by your software (the "user agent"), and the referring URL if your browser provided one. This information is collected by Vercel as a routine matter of operating any website hosted on its platform; the firm does not configure or customize this logging.
Vercel Web Analytics
The website includes Vercel Web Analytics, a privacy-focused first-party analytics product. Vercel Web Analytics does not use cookies, browser storage, or persistent identifiers. Unique visitor counts are computed by combining your IP address, your user-agent string, and a daily-rotating server-side hash to produce an anonymized identifier that lasts no longer than a single day. This permits aggregate counting of unique visitors without storing any persistent identifier on your device and without permitting any cross-site tracking.
The information collected through Vercel Web Analytics includes aggregate page views, the referring URL if any, country-level geographic information derived from your IP address, the type of device and browser you are using, and the screen size category. The firm uses this information to understand traffic patterns and to improve the website. Vercel's privacy practices for this product are published at vercel.com/legal/privacy-policy.
How we use information.
The firm uses the limited information described above for the following purposes only:
- To operate the website and deliver requested pages to your browser.
- To detect, investigate, and respond to potential security threats, attempted intrusions, or abusive behavior.
- To understand aggregate traffic patterns: which pages are visited, from which countries, on which device types.
- To improve the website's design, content, and performance over time.
The firm does not sell, rent, or trade any information collected through the website. The firm does not share information with advertisers, data brokers, or marketing platforms. The firm does not use information collected through the website to target you with advertising on this site or elsewhere.
No cookies or persistent identifiers.
The website does not use cookies. It does not use HTML5 local storage or session storage. It does not use any other client-side mechanism to store information on your device. You may verify this directly by opening your browser's developer tools and inspecting the Storage tab while visiting the site. No tracking technologies of any kind are set by the firm or by Vercel Web Analytics.
Because the website sets no cookies, there is no "cookie consent" banner to dismiss. The firm has chosen this architecture deliberately, both to respect visitor privacy and to keep the website simple and fast.
Third-party services.
Two third-party services are involved in delivering the website to your browser. Both receive information about your request only as necessary to perform their respective functions, and neither participates in any advertising, behavioral tracking, or cross-site identification.
Vercel
The website is hosted by Vercel Inc., which provides the content delivery network, server infrastructure, and analytics product described above. Information about your request necessarily passes through Vercel's systems. Vercel's privacy practices are governed by its published privacy policy.
Google Fonts
The website uses two typefaces — Bricolage Grotesque and Instrument
Serif — delivered via Google Fonts. When your browser loads the
website, it fetches the font files from fonts.googleapis.com
and fonts.gstatic.com. Google receives a request for the
font file, which includes your IP address and a referrer header
indicating that the request originated from the website. Google
states that it does not set cookies when serving fonts through this
service. Google's privacy practices are published at policies.google.com/privacy.
Email correspondence.
The website provides a mailto: link to
hello@tradeandservicemarks.com. When you click this
link, your own email application opens and you may compose a message
to the firm. Email you send to this address is delivered to and
stored in the firm's Microsoft 365 mailbox infrastructure. Microsoft's
privacy practices for Microsoft 365 are governed by the Microsoft
Online Services Privacy Statement.
Two important points about emailing the firm:
Sending an email does not create an attorney–client relationship. An attorney–client relationship requires mutual agreement and is typically established by a written engagement letter. The firm may decline to undertake any particular representation for any reason, including the existence of conflicts of interest. Until and unless the firm and the prospective client have agreed to representation in writing, no attorney–client relationship exists.
The attorney–client privilege does not attach to email sent before such a relationship is formed. Communications between a prospective client and a lawyer who has not yet agreed to undertake representation may be protected, in part, by certain professional confidentiality obligations and by limited prospective-client doctrines. They are not, however, protected by the full attorney–client privilege. The firm respects the confidentiality of communications it receives from prospective clients to the extent required by the Texas Disciplinary Rules of Professional Conduct, including Rule 1.05, and exercises judgment and care in handling such information. Visitors are nonetheless advised not to transmit information through email that they would not be prepared to have disclosed in any forum, until a formal engagement is in place.
State privacy rights.
Residents of states with comprehensive consumer privacy statutes — including without limitation California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Jersey, New Hampshire, Kentucky, Tennessee, Indiana, Maryland, Minnesota, Nebraska, and Rhode Island — may have certain rights regarding personal information collected about them, including rights to access, correct, delete, or know what has been collected. The specific rights available, and the procedures for exercising them, vary by state.
Because of the firm's minimal data collection (server logs and cookieless analytics only), most rights provided under these statutes have limited practical application to information collected through this website. Visitors who wish to exercise any state privacy right, or who simply wish to inquire about what information the firm has collected in connection with their visit, may contact the firm at the address provided below. The firm will respond within a reasonable time and consistent with the applicable statute.
Notice to California residents.
California residents are entitled to certain rights under the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the "CCPA"). These may include the right to know what personal information has been collected, the right to request deletion of personal information, the right to correct inaccurate personal information, the right to opt out of any sale or sharing of personal information, and the right to limit the use of certain categories of sensitive personal information. The firm does not sell personal information, does not share personal information for cross-context behavioral advertising, and collects no sensitive personal information through this website beyond the limited categories described above.

This website is not directed to children under the age of thirteen, and the firm does not knowingly collect any information from children under thirteen through this website. The firm complies with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501–6506. If you are a parent or guardian and you believe that a child under thirteen has provided information to the firm through this website, please contact the firm at the address provided below. The firm will promptly delete any such information upon verification.
A note about Texas.
The Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code §§ 541.001 et seq., took effect on July 1, 2024. The TDPSA imposes substantive obligations on entities that (1) conduct business in Texas or produce products or services consumed by Texas residents, (2) process or sell personal data, and (3) are not "small businesses" as defined by the United States Small Business Administration. The firm qualifies as a small business under the SBA definition and is therefore exempt from the substantive obligations of the TDPSA. The firm has nonetheless adopted this Privacy Policy as a good-faith statement of its actual privacy practices. Changes to this policy.
The firm may revise this Privacy Policy from time to time to reflect changes in its practices, in the technology used to operate the website, or in applicable law. The "Last updated" date at the top of this page indicates when the policy was most recently revised.
